Terms and conditions

This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

For the purpose of the Data Protection Act 1998, the data controller is Lee Downs and authorised individuals of Russells Limited.

Information we collect from you

We will collect and process the following data about you:

• Information you give us (Submitted information): This is information you give us about you by filling in forms on the App Site or by corresponding with us (for example, by e-mail or chat). It includes information you provide when you use the Work Wise Application. If you contact us, we may keep a record of that correspondence. The information you give us may include your name, address, e-mail address and phone number, the Device’s phone number, age, username and other registration information.
• Information we collect. Each time you visit one of our Sites or use one of our Apps we will automatically collect details of your use of any of our Apps or your visits to any of Our Sites (Log Information).

Uses made of the information

We use information held about you in the following ways:

• Submitted Information: Any information submitted is limited to Russells Limited or Russell Homes Limited internal use and specifically for health, safety, environmental and quality matters. No information is issued to third parties

Disclosure of your information

Save as detailed below we will not disclose the data we collect from you to any third parties.

You agree that we have the right to disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the Companies Act 2006.

We will disclose your personal information to third parties:

• In the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets.
• If Russells Limited or Russell Homes Limited or substantially all of its assets are acquired by a third party, in which case personal data held by it will be transferred.
• If we are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation or request.

Where we store your personal data

All information you provide to us is stored on our secure servers.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our sites; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Access to information

The Data Protection Act 1998 gives you the right to access information held about you. Your right of access can be exercised in accordance with that Act.

Changes to privacy policy

Any changes we may make to our privacy policy in the future will be notified to you when you next start the Work Wise App. The new terms may be displayed on-screen and you may be required to read and accept them to continue your use of the App.

Licence Restrictions

You agree that you will:

• not rent, lease, sub-lease, loan, provide or otherwise make available, the App in any form, in whole or in part to any person without our prior written consent;
• not copy the App, or any related online or electronic documentation except as part of the normal use of the App;
• not adapt, vary, alter or modify the whole or any part of the App any documentation or services not permit the App to be combined with, or become incorporated in any other programmes except as necessary to use the App;

You must:

• not use the App in any unlawful manner, for any unlawful purpose or in any manner inconsistent with these terms or act fraudulently or maliciously;
• not infringe our intellectual property rights or those of any third party in relation to your use of the App;
• not transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the App;
• not use the App in a way that could damage, disable or overburden, impair or compromise our systems or security or interfere with other users; and
• not collect or harvest any information or data from any service or our systems or attempt to decipher any transmissions to or from the servers running any service.

Intellectual Property Rights

All intellectual property rights in the App, the documentation and the services belong to us (or our licensors) and the rights in the App are licensed and not sold to you.

Governing Law

These terms are governed by English Law and the English courts shall have exclusive jurisdiction with regard to all matters arising in connection with or under this agreement
